MITO HIBACHI & SUSHI

Terms of Service

These Terms of Service apply to the Mito Hibachi & Sushi website and the information and online services available through it, including customer-service messaging when offered. They do not replace the terms agreed upon for a particular purchase, reservation, private event, or third-party service, or limit rights that applicable law does not allow to be waived.

1. Website use

You may use the website to view restaurant information, explore menus, access online ordering, learn about reservations and private events, and participate in available promotions. Provide accurate information and use these services lawfully. Do not impersonate another person, submit fraudulent requests, send unlawful or abusive content, interfere with operation, attempt unauthorized access, or use the service to send spam. You must have appropriate authority to place an order or make a booking on someone else's behalf.

2. Menus, pricing, and availability

Menu items, prices, hours, promotions, and availability may change. Photographs are illustrative; presentation and substitutions may vary. Review the information and any additional charges presented when ordering or booking. Contact the restaurant for clarification about an item, price, offer, or accommodation.

We may correct website errors subject to applicable law. A correction does not remove a consumer right or automatically change the terms of an already-confirmed purchase or booking. If an error affects an existing transaction, contact the restaurant or the provider that accepted it so the issue can be addressed.

3. Online orders and third-party services

The website links to providers such as Toast for ordering and OpenTable for reservations. Their terms, privacy notices, and any conditions shown at checkout or booking apply to the services they provide. Review the order, selected location, fulfillment method, timing, and contact details before submitting it.

For an order change, cancellation, delivery issue, or other problem, promptly contact the restaurant or the provider through which you ordered. Review any cancellation or refund conditions at the time of purchase. These website terms do not create a new cancellation fee, automatic no-refund rule, or waiver of a remedy available under applicable law.

4. Reservations and private events

Submitting an inquiry, sending a message, or receiving a general automated response does not by itself confirm a reservation or event booking. Confirmation must come from the restaurant or the applicable booking provider through its booking process.

Deposits, cancellation requirements, minimum purchases, timing, and other event conditions will be addressed in the terms provided for your particular booking. Review those conditions before agreeing or paying. A requested accommodation is not confirmed until the restaurant confirms it.

5. Promotions, loyalty offers, and gift cards

Promotions and loyalty benefits are subject to the eligibility requirements, expiration dates, exclusions, and redemption conditions stated with each offer. Review those conditions before ordering. Fraudulent or duplicate redemption attempts may be declined to the extent permitted by the stated offer and applicable law. Gift cards are subject to the terms shown by the issuer and applicable law; these website terms do not add an expiration date or fee.

Providing a phone number, joining a loyalty program, using customer-service messaging, or reading these terms does not by itself provide a separate marketing permission where the law requires one. Any required consent must be obtained through an appropriate, separately presented process.

6. AI-assisted customer messaging

When available, messaging on Google Business Profile may use an AI agent to answer common questions and help with reservation requests. Automated responses may be incomplete, incorrect, or out of date. They are not a substitute for a confirmed booking, a transaction confirmation, or a response from restaurant staff about a complex or sensitive request.

For food allergies, dietary concerns, accessibility or accommodation requests, complex events, disputed charges, or time-sensitive matters, contact staff directly at 586-393-5416. You can request a human response in a conversation. Staff availability and response time may vary; messaging is not an emergency service.

Google Business Profile customer messaging has its own service rules. Where that feature is available, STOP or UNSUBSCRIBE can stop messages through that service; a new customer message can reopen the conversation. Google's, the messaging provider's, and the mobile carrier's terms may also apply. Starting a customer-service conversation does not subscribe you to unrelated promotional messages.

7. Food allergies and dietary needs

Notify restaurant staff of food allergies or dietary restrictions before ordering and discuss whether an accommodation is available. Menu descriptions may not list every ingredient, and ingredients or preparation can change. Do not rely only on website descriptions, an automated response, or a prior visit to determine whether a dish is suitable.

Cross-contact can occur during restaurant food preparation. Discuss your specific needs with staff rather than assuming that a requested change makes a dish free of an allergen. This notice does not waive food-safety obligations, legally required disclosures, or liability that cannot lawfully be excluded.

8. Website content and privacy

Website text, photographs, logos, and other materials belong to their respective owners. Commercial copying or reuse requires permission from the applicable rights holder, except where permitted by law. Our Privacy Policy explains information handled through the website, inquiries, loyalty services, and messaging. A privacy notice is not a substitute for a consent that the law separately requires.

9. Website availability and limits

We do not guarantee that the website, interactive features, automated responses, or linked third-party services will always be available, secure, complete, or error-free. Contact the restaurant if online information or a feature is unavailable or appears incorrect.

To the extent applicable law allows, Mito is not responsible for indirect, special, or consequential losses arising solely from the use of, or inability to use, the informational portions of this website or an independent third-party service outside its control. This limitation does not exclude liability for fraud, intentional misconduct, gross negligence, personal injury where exclusion is prohibited, a breach of a confirmed purchase or booking, or another liability or consumer right that cannot lawfully be limited. It does not release Mito from its own legal duties.

10. Updates, applicable law, and other agreements

We may update these terms by posting a revised version with a new effective date. Updates do not retroactively override applicable consumer rights or terms already agreed upon for an existing purchase or booking. Additional terms presented for a specific transaction apply to that transaction, subject to applicable law.

Michigan law and applicable federal law govern these website terms, except where mandatory consumer protections require otherwise. If a provision cannot lawfully be enforced, the remaining provisions apply to the extent permitted by law. These terms do not require arbitration or waive a right to bring a claim.
